Zofran, a drug meant to reduce nausea and vomiting, was originally manufactured to help patients enduring cancer treatments such as chemotherapy and radiation.  For this purpose, the FDA approved Zofran as a safe drug for doctors to prescribe to their patients.  However, the company producing Zofran, GlaxoSmithKline, began marketing to more than just those suffering from cancer. The company discovered that Zofran was also able to sooth pregnant women suffering from morning sickness, and without any further testing or analysis, they began promoting it for that purpose.

It wasn’t long before doctors discovered a link between women who had taken Zofran while pregnant and babies being born with birth defects.  Although GlaxoSmithKline failed to perform proper testing on the drug, and were therefore just as unaware of possible side effects as anyone else, the animal testing that they did do was greatly misrepresented.  They sold the drug under a false declaration of safety, knowing that the animal testing showed significant signs of toxicity as well as abnormal bone development.

To say that it is unjust for a child to have to go through life with heart defects, a cleft lip or palate, a club foot, or skull deformities just because drug manufacturers were deceptive is an understatement.  If you or someone you know had a baby with birth defects after taking Zofran while pregnant, you might be eligible to take legal action.  Do not hesitate to contact us for a free case evaluation and we will help determine what your next steps are towards securing justice.
