NY Mother Files Lawsuit Against Zofran Producers

In New York, a mother has filed a lawsuit against GlaxoSmithKline, producers of Zofran, after her daughter was born with a cleft palate and a cleft lip.  During the first and second trimesters of her pregnancy, the woman took Zofran, as prescribed by her doctors, to treat morning sickness.  While GlaxoSmithKline markets their drug as a perfectly safe and reliable means of treating nausea, Zofran was never approved by the FDA for use by pregnant women.  Therefore, the company is acting outside of legal bounds by selling their products directly to obstetricians and gynecologists without the proper testing and approval.
